One of the most anticipated dates for workers is the month of March, since companies begin to pay profits according to the achievement of their results and annual profits. Utilities 2023: who receives this payment?
This mandatory compensation is received by all workers, nationals or foreigners, including those with indefinite-term, fixed-term, part-time, remote or teleworking contracts, as long as they are on the payroll and their companies have generated profits. .
“It is necessary to know that it is enough for the worker to have worked one day effectively within the year, to receive the payment of the utilities,” says Jaime Cuzquén, Associate Partner of the Labor Area of EY Peru.

Who does not receive the payment of utilities?
Profits are not accessed by those lessors of services or persons who issue receipts for fees, as well as those of the public sector, except for employees who work in state companies that apply to the private activity regime. Cuzquén highlights that in the case of civil construction, the profits here are given weekly throughout the year.

Utilities 2023: when should your company pay you?
As a general rule, the payment of profits by employers must be made within 30 days after the expiration of the term for the presentation of the Annual Income Tax Return. What companies do not share profits?
• Microenterprises accredited in the National Registry of Micro and Small Enterprises.
• Public sector institutions.
• Non-profit organizations.
• Cooperatives, communal and civil societies.
• Private companies that in 2022 had 20 workers or less.

If I am a former worker, do I also receive profits?
The answer is yes. The amount is calculated according to the days you worked and the salary you received during the year that corresponded to the profits.

How to calculate how much profit I will receive?
The factors to consider for the calculation of profits are:
• The total remuneration received by the worker during the year.
• The number of days worked during the year.

Thus, 50% of the final amount to be paid is associated with the days worked by the worker, and the remaining 50%, with his remuneration. It is important to specify that the calculation of profits also depends on the industry to which the company where you work belongs. These vary as follows:

• Fishing companies: 10%.
• Agricultural companies: 5% between 2021 and 2023; 7.5% between 2024 and 2026; and 10% from 2027 onwards.
• Telecommunications companies: 10%.
• Industrial companies: 10%.
• Mining companies: 8%.
• Wholesale and retail trade companies and restaurants: 8%.
• Companies that carry out other activities: 5%.
