The Ministry of Labor and Employment Promotion (MTPE) modified the regulations of the Law that regulates the granting of family allowances, through Supreme Decree No. 003-2023-TR.
The Labor authority, in this way, proceeded to adapt the regulations to the modification provided by Law No. 31600, which extended this benefit to workers with one or more children, over 18 years of age, with severe disabilities, duly certified, except who receive the non-contributory pension for severe disability established by Law No. 29973.
The rule also states that workers have the right to receive said family allowance until their children reach the age of 18, unless they are pursuing higher or university studies, in which case said benefit will be extended until their completion for a maximum of six years after reaching the age of majority.
In this way, the norm signed by the head of Labor, Alfonso Adrianzén Ojeda, modified article 6 of Supreme Decree No. 035-90-TR.
Therefore, the family allowance will correspond to workers with children over 18 years of age with severe disabilities, according to a report by Estudio Benites, Vargas & Ugaz Abogados.
