Workers can request paid leave for oncology exams

To access the permit, the employee must previously submit to his employer or higher authority the medical order in which the tests are indicated.

The Ministry of Labor and Promotion of Employment (MTPE) maintained that the personnel of the public and private sectors, without exception, have the right to request a license with pay per year to carry out oncological examinations in a preventive manner.

To access this permit, the worker must previously submit to his employer or higher authority the medical order in which the tests to be carried out are indicated. Later, he will present the documents that prove that this care was received.

In accordance with the provisions of Law No. 31479, which incorporates article 12 of the National Cancer Law (Law No. 31336), the requested license will be compensable.

For this reason, workers in accordance with what the regulation indicates: are entitled to an annual compensable leave, for up to two business days, consecutive or not, to undergo their oncological preventive examinations.

The leave granted to the worker will be compensable with working hours that will be agreed with the employer, the portfolio specified on World Cancer Day.

Cervix

On the other hand, the MTPE explained that, in the case of female workers, they are entitled to one day of paid leave per year to undergo early detection tests for breast and cervical cancer.

This specific license does not require compensation, in accordance with the Law for the prevention of cancer in women and the strengthening of specialized oncological care (Law No. 31561).

Companies that fail to grant labor licenses in the indicated cases may receive a sanction, since this offense is typified in the Regulations of the General Labor Inspection Law as a very serious infraction.
